Indemnity, Waiver and Release
- “Activity” means the participation in, use of, or reliance of, any products or services supplied (whether directly or indirectly) or otherwise by AutoEd.
- “AutoEd” means AutoEd Holdings Pty Ltd trading as AutoEd -
“I” and “me” means any individual and/or legal person that signs this form where it says “Customers Signature”
Indemnity, Wavier and Release
In agreeing to these Terms and Conditions, you agree to the following:
I acknowledge that it is a condition of participating in this program that I do so at my own risk.
I accept all risks and hereby indemnify and release AutoEd, their agents, affiliates, employees, members, sponsors, promoters and any person or body directly and/or indirectly associated with AutoEd against all liability (including liability for negligence and the negligence of others, contract, under statute (as far as permissible), in equity or at law) including all actions, suits, claims, demands, expenses, obligations or liabilities either at law or in equity or arising under a statute and irrespective of whether the matters giving rise to those claims or otherwise are known to me or ought to be known to me as at the date of signing this form, and whether relating to my participation in this Activity or otherwise.
This indemnity, wavier and release continues forever and binds my heirs, successors, executors, personal representatives and assigns.
I acknowledge that participating in this Activity may involve a risk of serious injury or even death from various causes, and may cause damage to my property, including my vehicle or the property of others.
I acknowledge that there may be a level of physical exertion required and I am physically and mentally fit to participate safely in the Activity. I am not aware of any medical condition, injury or impairment that could be detrimental to my health if I participate in this Activity.
I certify that I am 15 years or older and I have read this document and fully understand it.
TERMS AND CONDITIONS - Courses
We make every effort to ensure that all the information and content on our website and in our courses and course materials is accurate and kept up-to-date.
We do not guarantee the accuracy, reliability or currency of the materials or information provided by us.
We give no warranty, make no representation nor give any undertaking whether express or implied, nor do we assume any liability, whether direct or indirect, or responsibility for the accuracy, completeness or usefulness of any information, content, courses or course materials provided by us.
The courses and course materials and information that we provide does not purport to constitute professional advice. We accept no responsibility for and make no representations, whether express or implied, as to the accuracy or reliability in any respect of any course material, course or information provided by us.
Except to the extent provided by legislation, we do not accept responsibility for the consequences of or any reliance which may be placed by any person on any course material, course or information provided by us.
We will not be liable to you or to any other person for any loss or damage (including direct, consequential or economic loss or damage) however caused and whether by negligence or otherwise which may result directly or indirectly from the use of course material, or information or a course provided by us.
Acknowledgement Release and Waiver
You acknowledge that you participate in any course offered by us having first acknowledged and agreed to the terms of the disclaimer set out above.
You further acknowledge that any course offered by us will not lead to any formal accreditation, certification or qualification and may not be recognised as prior learning with respect to any other accreditation, certification or qualification.
You acknowledge and agree that you release us and each of our directors, officeholders, employees and contractors from all and any claims that you may otherwise have against us in respect of any information, course or course materials that may be provided to you.
You waive any right to make any claim against us or any of our directors, officeholders, employees or contractors in respect of any information, course or course materials that may be provided to you or upon which you may otherwise have relied.
You agree not to commence any proceedings or take any action to enforce or maintain any claim against us or any of our directors, officeholders, employees and contractors and you agree to indemnify us and each of our directors, officeholders, employees and contractors against any liability, loss or costs arising from any breach by you of this agreement.
Claim means any claim, action, proceeding or entitlement whether past, present or future whether known or unknown which you or any other person has or might have under or arising out of or in any way connected to a contract or other arrangement with us.
Payments, Refund and Cancellation Policy
Payments for courses must be made in full prior to us providing you with any course material.
You will be eligible for a full refund of fees paid if we cancel the nominated course before you have logged in to access the course. This will incur no administrative charges or penalties.
We do not offer refunds or credit notes under ANY other circumstances.
No refund of fees or release from financial commitment will be granted for non-completion of a course.
Course Expiry & Access
You will be given a unique code to access your course material. This access code may only be used by you and must not be used by any another third party.
You can continue to access your course online as long as:
- the course remains active on our website;
- the course is not currently being reviewed or improved;
- you have paid your account in full;
You acknowledge that you must not share the code with any other person and the materials provided to you are for your use only. If you share the materials with any other person your code will be cancelled and you will not be able to access the course nor will you be entitled to a refund. You may also be liable to our client for damages.
TERMS AND CONDITIONS - Products
Your receipt of an electronic or other form of order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. AutoEd reserves the right at any time after receipt of your order to accept or decline your order for any reason or to supply less than the quantity you ordered of any item.
Payment of product/s ordered must be received prior to the product/s being shipped.
We accept PayPal and the following credit cards: Visa and MasterCard payments are made through STRIPE. Please be sure to provide your exact billing address and telephone number (i.e. the address and phone number your credit card bank has on file for you). Incorrect information will cause a delay in processing your order. Your credit card will be billed upon shipment of your order.
We will ship your product as it becomes available. Products may take up to 6 weeks to be delivered within Australia and longer outside of Australia.
There may be times when the product you have ordered is out-of-stock which will delay fulfilling your order. We will keep you informed of any products that you have ordered that are out-of-stock and unavailable for immediate shipment. You may cancel your order at any time prior to shipping.
An information pamphlet will be provided to you to guide you on how to set up and use the product for its intended purpose. You must comply with the directions contained within the pamphlet, failure to do so may result in the product being damaged.
Should you not comply with the information supplied by our client all warranties will be automatically void.
The customer shall inspect the products on delivery and shall within three (3) days of delivery notify AutoEd of any alleged defect, damage or failure to comply with the description or quote. If the customer fails to comply with these guidelines, the products shall be conclusively presumed to be in accordance with the terms and conditions and free from any defect or damage. AutoEd will cover shipping expenses for any return that complies with these guidelines, unless outlined otherwise.
Products must be returned in the same condition they are received. Products will not be eligible for return if there is any further damage, marking or engraving on the item.
A return can be made if:
- The item is received damaged
- The item is not as described at purchase
- The item is being returned for repair
AutoEd is not responsible for any loss or damage during transit if the customer has not registered for private shipping insurance.
If an incorrect purchase were made by the customer and the product is unwated we may agree to accept a return so long as it is within 30 days of purchase and the product is unused, in brand new condition and in its original packaging (if any). Shipping and restocking fee will apply.
If the return is due to an incorrect purchase you will be required to ship the product at your expense and a re-stocking fee of 15% of the purchase price of the product will be deducted from the refund.

After organising the return of the item(s) you will be emailed a return label, then you will send the parcel using the return label at closest Australia Post depot. If the return is due to an incorrect purchase you will be required to take our delivery address and ship the product at your expense.
Once the item(s) has been received a Customer Service Representative will make contact and action the return as soon as reasonably practical. If a refund is applicable it will be processed within a reasonable time after contact has been made.
In the event of an exchange, the replacement item(s) will be sent within a reasonable time after receipt of the original item(s).
Important - When returning an item you must include a copy of your invoice along with a note for reason of the return.
If a refund is applicable it will be processed within a reasonable timeframe after receiving the returned item. The refund will be processed through bank transfer, credit card refund, or PayPal refund depending on how you made your purchase.
Responsibility for Return Shipping Costs
Return and exchange shipping costs will be paid by AutoEd unless the item(s) is being returned due to customer error.
All of our products come with a 6-month warranty. The warranty will however be void in the event you do not use the product for its intended proper use or the fault is caused by your conduct.
Batteries are excluded from warranty as is any water damage to any products.
Multiple Product Orders
For a multiple product order, we will make every attempt to ship all products contained in the order at the same time. Products that are unavailable at the time of shipping will be shipped as they become available, unless you inform us otherwise. You will only be charged for shipping at the rate quoted to you on your purchase receipt. The entirety of this shipping charge may be applied to the first product(s) shipped on a multiple shipment order.
In the event a product is listed with an incorrect image, an incorrect price due to typographical error or error in pricing information received from our suppliers, AutoEd shall have the right to refuse or cancel any orders placed for product listed incorrectly. AutoEd shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and payment has been processed. If payment has been taken for the purchase and your order is canceled, AutoEd shall immediately issue a refund back to your account.

AutoEd may grant a an AutoEd ClubCard to relevant participants of the Road Hero Course for discounts on goods and services with participating companies and areas. This card may only be available to participants in select areas due to affiliate company participation. These ClubCards may be valid for up to and including 1 year (12 months) from date of issue, please see expiry date on individual card. This card is subject to participating companies terms and conditions business specific and may not grant discounts on all products or services. A renewal of the AutoEd Club Card may be purchased for an additional fee, for this information please see our website www.autoed.com.au or contact mike at email@example.com.. Terms and conditions may change at any time without notice or notification. AutoEd reserves the right to cease the ClubCard program at any time regardless of individual card expiry date.
These Conditions will supersede any terms and/or conditions you include with any purchase order, regardless of whether AutoEd signs them or not. We reserve the right to make changes to this site and these Conditions at any time.
